1. Agreement to Terms

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you and Omni Horizon Technology, a company incorporated in the United Kingdom (“Company”, “we”, “us”, or “our”), concerning your access to and use of the Switchways mobile application (“the App”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Eligibility

The App is intended for users aged 13 and older. By using the App, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that you have obtained parental or guardian consent to use the App. We reserve the right to terminate accounts that do not meet these requirements.

3. User Accounts

You may create an account using Google Sign-In or Apple Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration. You must notify us immediately of any unauthorised use of your account.

4. In-App Purchases

The App may offer in-app purchases for cosmetic items (such as board themes and avatars) and premium features. All purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms and conditions.

• All transactions are final. Refunds are subject to the refund policies of the Apple App Store or Google Play Store.
• Subscriptions, if offered, will automatically renew unless cancelled before the end of the current billing period. Cancellation takes effect at the end of the current billing cycle.
• Purchased items are licensed to you and remain the property of Omni Horizon Technology. They have no real-world monetary value and cannot be transferred, traded, or refunded except as required by law.

5. User Conduct

By using the App, you agree not to:

• Use cheats, exploits, automation software, bots, hacks, or any unauthorised third-party software
• Harass, abuse, threaten, or engage in harmful conduct towards other players
• Create multiple accounts to manipulate rankings, matchmaking, or leaderboards
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use the App for any unlawful, fraudulent, or malicious purpose
• Interfere with or disrupt the integrity or performance of the App or its servers
• Attempt to gain unauthorised access to the App, other accounts, or any related systems

We reserve the right to investigate and take appropriate action against anyone who violates these rules, including suspending or terminating their account without notice.

6. Intellectual Property

All content in the App — including but not limited to graphics, artwork, designs, game mechanics, board themes, character designs, audio, source code, and trademarks — is the exclusive property of Omni Horizon Technology and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, or publicly display any part of the App without our prior written consent.

7. User Feedback

Any feedback, suggestions, or ideas you submit to us regarding the App become the property of Omni Horizon Technology. We may use, modify, and implement such feedback without any obligation or compensation to you.

8. Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Omni Horizon Technology and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the App, whether based on warranty, contract, tort, or any other legal theory. Our total liability shall not exceed the amounts paid by you to us in the six (6) months preceding the event giving rise to the claim.

10. Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause and with or without notice, for any reason including but not limited to a violation of these Terms. Upon termination, your right to use the App will immediately cease. You may also delete your account at any time by contacting us. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to Terms

We may update these Terms from time to time at our sole discretion. We will notify you of material changes by posting the updated Terms within the App or by other reasonable means. Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
